By accessing or using Phaseview Inc. ("Phaseview," phaseview.ca) and any associated services (collectively, "the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference.

Phaseview is an informational platform that provides access to publicly available environmental assessment reports, geospatial analysis tools, and data visualization for locations in Western Canada.

Your continued use of any free tier will not require payment.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purposes, subject to these Terms.
"User Content" means any content you post, upload, or submit through the Service, including forum posts, comments, and profile information. You retain ownership of your original User Content. By submitting User Content, you grant Phaseview a worldwide, non-exclusive, royalty-free, perpetual, sublicensable license to use, reproduce, display, distribute, and create derivative works from your User Content for the following purposes:
You represent and warrant that you have the right to post such User Content, that it does not violate any third-party rights, and that it complies with these Terms and all applicable laws.
Environmental reports accessible through the Service are sourced from publicly accessible regulatory databases and government sources. Phaseview does not claim ownership of these reports. The original authors, consultants, and regulatory bodies retain their respective rights.
Users may access and use environmental reports and geospatial data through the Service for internal professional and business purposes. The following activities are prohibited without prior written authorization from Phaseview:

Phaseview uses automated classification and data processing techniques to organize, categorize, and present environmental data. These processes include document classification, metadata extraction, and geospatial data processing.
Automated processes may produce errors in classification or data extraction. As stated in our disclaimers, users should independently verify all data before making decisions based on information obtained through the Service.
If we introduce AI-powered features that process user-provided data in the future, we will update this section and notify users in advance.
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms an integral part of these Terms.
We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Alberta's Personal Information Protection Act (PIPA) with respect to the collection, use, and disclosure of personal information.

THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. YOU ACKNOWLEDGE AND AGREE THAT YOU WILL NOT RELY ON THE SERVICE OR ANY INFORMATION, DATA, OR CONTENT AVAILABLE THROUGH THE SERVICE AS PROFESSIONAL ADVICE.
While we strive for accuracy, Phaseview makes no representations or warranties regarding the completeness, accuracy, reliability, timeliness, or suitability of any environmental data, reports, analyses, or any other information, data, or content available through the Service. Environmental data may contain errors, omissions, or outdated information from original source databases. Geospatial coordinates and boundary data sourced from third-party datasets may contain georeferencing offsets or positional inaccuracies inherent in the original source data.
The Service does not constitute professional environmental advice. Users must independently verify all data and consult qualified environmental professionals before making regulatory, business, or environmental decisions.
Specifically, the Service:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PHASEVIEW, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO:

If you have a paid subscription, our total cumulative liability for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you have paid us in the six (6) months preceding the claim, or (b) one hundred Canadian dollars (CAD $100). If you are using the Service on a free plan, our total cumulative liability shall not exceed one hundred Canadian dollars (CAD $100). These limitations do not apply to liability that cannot be excluded under applicable law.
You agree to indemnify, defend, and hold harmless Phaseview, its officers, directors, employees, contractors, agents, and successors from and against any and all claims, damages (whether direct or indirect), losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

If informal resolution is unsuccessful, any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the courts of competent jurisdiction in the Province of Alberta, Canada. Both parties consent to the personal jurisdiction of such courts.
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy and any other legal notices or policies published by Phaseview on the Service, constitute the entire agreement between you and Phaseview regarding the Service.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Phaseview.
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
By using the Service, you consent to receiving communications from us electronically, including emails, notices posted on the Service, and in-app notifications. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
We reserve the right to modify these Terms at any time. When we make material changes, we will:

Users must independently verify all data against authoritative sources and consult with qualified environmental professionals before acting on any information obtained through the Service.
Nothing in the Service creates a professional-client, consulting, engineering, legal, or fiduciary relationship between Phaseview and any user. Phaseview assumes no responsibility for decisions made based on the data or analyses provided through the Service.
